The Appeal Chamber held on July 19, 2019, at 10:00 h, the public hearing of case (JR) no. 34/2018, dated 13.11.2018, corresponding to the appeal of the Public Commissioner against decision no. 62 dated 03.08.2018 of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Artur Malaj.
During this hearing the Public Commissioner filed a preliminary request to reinstatement of time limits to file an additional appeal, in view of two findings of previously unknown information, made available by the International Monitoring Operation
The assessee opposed the request of the Public Commissioner considering it procedurally ungrounded, and requested the panel to dismiss it.
Once the adjudication panel accepted the request of the Public Commissioner, the latter submitted the grounds of the initial appeal and additional appeal, and requested the adjudication panel to conduct a thorough financial analysis, based on the evidences filed up to this stage of the proceedings.
The Public Commissioner founded such request in the outcomes of the financial analysis carried out by him, the results of which established the conviction that the decision of the Independent Qualification Commission is vulnerable with regard to asset pillar, therefore a thorough examination of the Chamber is needed with this respect to this criterion.
The Public Commissioner responded to several questions addressed to him by the panel with regard to the additional appeal. To the purpose of clarifying the limits of the appeal, the adjudication panel requested the Public Commissioner to set within July 24, 2019 at the disposal of the Chamber the financial analysis, in order to forward it to the assessee.
The adjudication panel decided to adjourn the hearing on September 6, 2019, at 10:00 h. The public hearing shall be held at the premises of the Appeal Chamber, at: Bulevardi “Dëshmorët e Kombit”, nr.3. Tirana.
