Today, on 28.03.2021, at 10:00, the Appeal Chamber held the public hearing of case (JR) 19/2021, dated 19.04.2021, corresponding to the appeal of the Public Commissioner against decision no. 342, dated 02.02.2021, of the Independent Qualification Commission, related to the assessee Elbana Lluri.
The Public Commissioner submitted the appeal grounds related to the asset assessment, requesting the Appeal Chamber to take them into consideration, open the judicial investigation, collect relevant evidence and calculate the data in order to verify the financial sources that have served to create the assets of the assessee, according to the requests in the appeal.
The assessee, Mrs. Elbana Lluri, submitted her objections related to the appeal grounds of the appeal of the Public Commissioner as well as to the public denunciations, requesting the Chamber to collect as evidence certain acts found in the case file of the Independent Qualification Commission, as well as some new acts filed during today’s hearing in response to the issues raised in the public denunciations. The assessee requested the upholding of decision no. 342, dated 02.02.2021 of the Independent Qualification Commission.
The Public Commissioner, when questioned by the presiding judge, stated his consent to collect as evidence the new acts filed by the assessee, Mrs. Elbana Lluri, leaving at the court discretion the collection as evidence of the repeated acts.
Once the International Observer of the International Monitoring Operation addressed some clarifying questions to the assessee in view of the consideration of the case, the trial panel decided:
- acceptance and collection as evidence of the acts submitted by the assessee, not found in the case file of the Independent Qualification Commission;
- the Appeal Chamber shall carry out a financial analysis on the basis of the appeal grounds of the Public Commissioner, to be made available to the parties before the next hearing, scheduled to take place on May 4, 2022, at 09:00.
The public hearing will take place in the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.
