Today, on 13.09.2022, at 10:00, the Appeal Chamber held the public hearing of case (JR) 42/2020, dated 30.09.2020, pertaining to the appeal of the Public Commissioner against decision no. 269, dated 01.07.2020, of the Independent Qualification Commission, related to the assessee Valdete Hoxha.
During the submissions of the appeal grounds, the Public Commissioner, Mrs. Irena Nino, stated that the assessee, Mrs. Valdete Hoxha made an inaccurate and insufficient declaration on the asset assessment criteria and requested the Chamber to carry out a further assessment of the assets, by opening the judicial investigation of the case and collecting the necessary evidence.
The assessee, Mrs. Valdete Hoxha, contested the appeal grounds of the Public Commissioner, maintaining that they are inconsistent and unsupported in evidence and law. The assessee stated that she has managed to convincingly prove the legitimate source for the creation of her assets, and that she has reached a reliable level for this criterion as well. Mrs. Valdete Hoxha filed several documents in support of her submissions, which she requested to be collected as evidence in this proceedings, in case the court would accept the request of the Public Commissioner for opening the judicial investigation.
Once the assessee responded to some clarifying questions of the case rapporteur, the panel withdrew for consultation, deciding: to open the judicial investigation and allow the collection as evidence of the documents filed by the assessee in connection with today’s submissions. The trial panel decided also to accept some documents identical to those filed by the assessee with the Independent Qualification Commission on July 16, 2020, but provided with an apostille stamp.
Given the request of the Public Commissioner for the provision of sufficient time to take a position regarding some public denunciations, the panel decided to postpone the hearing to September 23, 2022, at 09:00. During this hearing, the parties must also be prepared for the submissions of the final conclusions.
The public hearing will take place in the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.
