The Appeal Chamber held on 19.06.2020, at 12:30 h, the public hearing on the case (JR) no. 10/2019, dated 29.02.2019, corresponding to the appeal of the Public Commissioner against decision no. 86, dated 17.12.2018, of the Independent Qualification Commission related to the transitional re-evaluation process of the assessee Alma Kolgjoka.
During today’s public hearing, the presiding judge cited the documents and acts submitted with the Appeal Chamber in response to the requests of the adjudication panel for additional information for the purpose of the case review.
In addition to these acts, the assessee, Mrs. Kolgjoka along with her objections, submitted several new additional acts, upon which she requested to be administered as evidence.
The Public Commissioner in his objections stated that the answers resulting from the investigation of the Appeal Chamber are exhaustive and complement the non-thoroughly investigation carried out by the IQC for the apartment asset in Tirana, owned by the relative of the assessee.
After administering the evidence submitted with the Appeal Chamber as a result of the investigation, as well as the evidence submitted by the assessee, Mrs. Alma Kolgjoka, the adjudication panel decided to conclude the judicial investigation of the case and invited the parties to express their final conclusions.
During the final conclusions, the Public Commissioner stated that paragraph 1 of Article 59 of Law no. 84/2016 applies to the assessee and for this reason the PC requested the upholding of the decision no. 86, dated 17.12.2018 and the confirmation in duty of the assessee.
The assessee, Mrs. Kolgjoka, stated that upon the new facts in this proceeding, it was categorically and exhaustively proved that her relative could not be qualified as other related person. The assessee requested the upholding of decision no. 86, dated 17.12.2018, of the Independent Qualification Commission.
After hearing the final conclusions of the parties, the adjudication panel withdrew to make the final decision on the case, which shall be announced on 25.06.2020, at 09.30.
The public hearing shall take place at the premises of “Pallati i Koncerteve”, Bulevardi “Dëshmorët e Kombit”, Tirana.
