Today, on 11.05.2023, at 10:00, the Appeal Chamber held the public hearing of case (JR) 6/2021, dated 26.01.2021, pertaining to the appeal of the Public Commissioner and the appeal of the assessee Irena Brahimi against decision no. 276, dated 21.07.2020, of the Independent Qualification Commission.
The Public Commissioner submitted the appeal grounds in relation to the asset and proficiency assessment criteria, requesting the upholding, or alternatively, the amendment of decision no. 276, dated 21.07.2020 of the Independent Qualification Commission.
The assessee, Ms. Brahimi, provided explanations with regard to her appeal against decision no. 276, dated 21.07.2020, of the Independent Qualification Commission, and filed as well objections against to the Public Commissioner’s appeal grounds. The assessee requested the Chamber the upholding of decision no. 276, dated 21.07.2020 of the Independent Qualification Commission and confirmation in office.
Following the court debate, in the context of the respective requests of the Public Commissioner and the assessee addressed to the AC in view of the examination of the case, after being consulted, the panel decided:
– opening the judicial investigation of the case, accepting as evidence all the documents filed by the assessee attached to the submissions filed in today’s hearing;
– by a majority vote, the conduct of a preliminary financial analysis related to the Public Commissioner’s appeal grounds and assessee’s claims related to the asset assessment. This financial analysis will be forwarded to the parties, for acquaintance purposes, by May 25, 2023;
– making available to the assessee an information on a publication of a media portal, part of the Public Commissioner’s appeal within the proficiency assessment. This information will be forwarded to the assessee, Ms. Irena Brahimi, to take a stand during the next hearing, which will take place on 05.06.2023, at 10:00. In this hearing, the panel shall also make a statement regarding the information on the publication of the media portal.
The public hearing will take place in the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.
