On 26.06.2024, the Appeal Chamber held the public hearing of case (JR) 29/2021, dated 28.05.2021, pertaining to the appeal of the Public Commissioner against decision no. 352, dated 01.03.2021 of the Independent Qualification Commission, related to the assessee Iliba Bezati.
The Public Commissioner submitted the appeal grounds on the asset and proficiency assessment criteria, requesting the AC to take them into consideration, ordering the opening of the judicial investigation and the collection of relevant evidence, according to the request in the appeal.
The assessee, Mrs. Iliba Bezati, provided her explanations in view of the appeal, requesting the AC to open the investigation and collect as evidence three new acts related to her submissions, in terms of the examination of the case. The assessee held that the assessment of the Independent Qualification Commission, according to which the assessee has reached a reliable level in the asset and background assessment and a qualifying level in the proficiency assessment, is fair and substantiated on law and evidence. The assessee requested the upholding of decision no. 352, dated 01.03.2021 of the Independent Qualification Commission.
Following some questions on the case addressed to the assessee by the International Observer of the International Monitoring Operation, the trial panel, after being consulted, decided:
– To open the judicial investigation and pursuant to Article F, paragraph 3 of the Annex to the Constitution, and Articles 45, 49, paragraph 1 (a), of Law no. 84/2016, collect as evidence the three acts filed by the assessee.
– Upon a majority vote, request the Public Commissioner to determine which concrete conclusions of the Independent Qualification Commission regarding the items of the financial analysis of the assessee he opposes, and the financial effect they produce in the final evaluation of this analysis.
In order to give the necessary time to the Public Commissioner to prepare his position, the trial panel decided to adjourn the hearing to 11.07.2024, at 10:00, asking the Public Commissioner to submit the requested material with the AC within 03.07.2024, in a way that it may also be forwarded to the assessee before the next hearing.
The public hearing shall take place at the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.
