Today, on 28.06.2024, at 09:00, the Appeal Chamber held the public hearing of case (JR) 23/2023, dated 26.05.2023, pertaining to the appeal of the Public Commissioner against decision no. 657, dated 28.04.2023 of the Independent Qualification Commission, related to the assessee Periand Teta.
During the submission of the final conclusions, the Public Commissioner held that she stands by all the appeal grounds filed in the hearing dated 25.06.2024 and finally requested the Chamber the amendment of decision no. 657, dated 28.04.2023 of the Independent Qualification Commission, termination of the transitional re-evaluation process and, according to Article G of the Annex to the Constitution, the prohibition of the assessee to be appointed a judge or prosecutor of any level, a member of the High Judicial Council or High Prosecutorial Council, High Justice Inspector or Prosecutor General for a period of 15 years.
The assessee, during the submission of the final conclusions, maintained that he finds that the Public Commissioner has elaborated new grounds in the appeal, both in the previous hearing and in today’s hearing, which places the parties in unequal positions. The assessee requested the Chamber to evaluate the appeal of the Public Commissioner, taking into consideration this finding of his.
Finally, the assessee requested the Chamber to, alternatively, decide to uphold the IQC decision, or overrule this decision and order the Independent Qualification Commission to continue the re-evaluation process for the assessee Periand Teta, under Article 66, paragraph 1 (c), of Law no. 84/2016, “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”.
After hearing the final conclusions of the parties, the trial panel withdrew to make the final decision, which it shall announce on 17.07.2024, at 14:00.
The public hearing shall take place at the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.
