The Appeal Chamber held on 11.07.2025, at 13:00, the public hearing of case (JR) 11/2023, dated 10.03.2023, pertaining to the appeal of the Public Commissioner against decision no. 607, dated 22.12.2022 of the Independent Qualification Commission, related to the assessee Kledian Llaho.

Preliminarily, the assessee submitted two requests, along with several acts, demanding:

• The suspension of the examination at the Appeal Chamber of the re-evaluation jurisdiction case (JR) 11/2023, dated 10.03.2023 until a final decision is made regarding two disciplinary jurisdiction cases registered as well with the Appeal Chamber, with applicant the magistrate Kledian Llaho, with scope, the challenging of the two decisions of the High Prosecutorial Council which imposed disciplinary measures against him;
• suspension of the examination at the Appeal Chamber of the re-evaluation jurisdiction case (JR) 11/2023, dated 10.03.2023, until the resolution by a final judicial decision of a criminal case initiated against him by the Special Prosecution office.

After hearing the position of the representative of the Head of the Special Prosecution office, Mr. Klodian Braho, who maintained that the appeal contains no legal grounds and facts related to the issues referred to by the assessee, the trial panel decided to dismiss the requests of Mr. Kledian Llaho as unfounded in facts and law.

Following the opening of the judicial review, the representative of the Head of the Special Prosecution office continued with the submission of the appeal grounds, assessing that the assessee is found in terms of inconsistent, incorrect and insufficient declaration of assets. With regard to the background assessment, Mr. Braho stated that, from the information of the law enforcement bodies, there are indicia that the integrity of the assessee should be considered deficient, while Mr. Llaho has provided no convincing explanations and has not managed to dispel the burden of proof regarding the proficiency assessment criterion, being found in terms of violation of public trust in the justice system. The representative of the Head of the Special Prosecution Office finally requested the amendment of decision no. 607, dated 22.12.2022 of the Independent Qualification Commission and the dismissal from office of the assessee.

After hearing the submission of the appeal grounds of the representative of the Head of the Special Prosecution office, due to the excessive duration of the hearing, the trial panel decided to interrupt it, to continue on 23.07.2025, at 09:00.

The public hearing shall take place at the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.
