The Appeal Chamber held on 11.07.2025, at 09:00, the public hearing of case (JR) 7/2023, dated 14.02.2023, pertaining to the appeal of the Public Commissioner against decision no. 605, dated 21.12.2022 of the Independent Qualification Commission, related to the assessee Armida Hamiti (Moçka).
During the submission of the final conclusions, Mr. Adnan Xholi, authorized in this hearing as the representative of the Head of the Special Prosecution Office, stated that after the consideration of the case at the Appeal Chamber, based on the current state of the acts, it turns out that the shortcomings identified in the asset assessment criterion are not as such as to justify the sanction of dismissal from office of the assessee, while no indica or doubt is observed regarding the other two criteria, proficiency and background assessment. Mr. Xholi stated that, based on the above, but also due to the specifics of this case, where it results that the assessee was not in the position of prosecutor or in any other public office at the time of the creation of the declared assets and had no possibility to influence their creation through abuse of office, he finally requests the Chamber the upholding of decision no. 605, dated 21.12.2022 of the Independent Qualification Commission.
The assessee continued with the final conclusions, holding that she has managed to dispel the burden of proof and convincingly prove the legitimacy of the source of creation of the assets. Finally, the assessee requested the Chamber the dismissal of the appeal and the upholding of decision no. 605, dated 21.12.2022 of the Independent Qualification Commission.
Subsequently, the International Observer of the International Monitoring Operation questioned the representative of the Head of the Special Prosecution Office regarding the clarification regarding the final request. In response to the question, Mr. Xholi clarified the final request of the Head of the Special Prosecution Office, confirming that the decision of the Independent Qualification Commission was fair and supported on evidence and law.
The trial panel decided to close the judicial review of the case and withdrew in chambers to make the final decision, which it shall announce on 17.07.2025, at 09:30.
The public hearing shall take place at the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.
