On 30.03.2021, at 10:00, the Appeal Chamber held the public hearing of the case (JR) 28/2020, dated 10.07.2020, corresponding to the appeal of the Public Commissioner against decision no. 231, dated 29.01.2020, of the Independent Qualification Commission related to the assessee Anton Martini.
Following the verification by the presiding judge of the litigants’ presence, the legal representative of assessee submitted a preliminary request, upon which he asked the trial panel to consider the dismissing of the Public Commissioner’s appeal.
After withdrawing for consultation, the trial panel decided that the request of the assessee regarding the object of his appeal, shall be addressed and analyzed in the framework of the overall assessment of the Public Commissioner’s appeal, pursuant to the provisions of Article 450, paragraph 3 of Code of Civil Procedure.
During the submission of the appeal grounds, the Public Commissioner deemed that the assessee fails to reach a trustable level to be confirmed in office for his assets assessment and the proficiency assessment criteria and that the decision of the Independent Qualification Commission is vulnerable in its entirety. The Public Commissioner requested the Appeal Chamber to take into consideration the appeal grounds, to amend decision no. 231, dated 29.01.2020, of the Independent Qualification Commission and dismiss from office the assessee Anton Martini.
Initially, the legal representative of the assessee submitted his submission for the dismissal of the Public Commissioner’s appeal, claiming that this appeal was lodged outside the legal deadline of 15 days.
Then, the legal representative and the assessee thoroughly read out loud their objections in response to the appeal of the Public Commissioner, by submitting new acts for the purpose of the case review.
After hearing the submissions of the parties, the trial panel decided to make available to the Public Commissioner and to the assessee three public denunciations and asked them to comment on them, in formal terms, at the next hearing scheduled to be held on 01.04. 2021, at 14:00. The trial panel asked the Public Commissioner that in the same hearing, to state his position whether the new submitted acts by the assessee in today’s hearing contain all of the required formal elements.
The public hearing shall be held at the premises of the Appeal Chamber, at: Bulevardi “Dëshmorët e Kombit”, nr.3. Tiranë.
