Today, on 27.04.2021, at 10:00, The Appeal Chamber held the public hearing of the case (JR) 53/2019, dated 25.10.2019, related to the appeal of the Public Commissioner against decision no. 183, dated 19.07.2019 of the Independent Qualification Commission, corresponding to the assessee Petrit Çano.
Following the verification of litigants’ presence, the legal representative of the assesse, when asked by the presiding judge, submitted a preliminary request, upon which he asked the trial panel to not accept the appeal of the Public Commissioner because in his assessment, the Public Commissioner has lodged the appeal outside the legal time limits.
After withdrawing for consultation, the trial panel held that the request of the assessee to not accept the appeal, shall be treated in the framework of the overall assessment of the appeal of the Public Commissioner, based on the requirements of Article 450, paragraph 3, of the Code of Civil Procedure.
Through the submission of the appeal grounds, the Public Commissioner asked the Appeal Chamber to open the judicial investigation and to administer additional documentation and information in order to carry out this investigation for the three criteria, assets, background and proficiency assessment.
The legal representative and the assessee submitted their objections regarding the appeal grounds raised by the Public Commissioner related to the asset and background criteria, considering them unfounded and asked the Appeal Chamber to obtain new evidence to oppose them. Regarding the proficiency criterion, the legal representative stated that the Public Commissioner has not raised any claims in his appeal for this criterion and since these claims exceed the appeal and have been subject to verification by High Judicial Council, they should not be reviewed by the Appeal Chamber.
In response to the appeal grounds and the two denunciations delivered at the Appeal Chamber, the assesse submitted new acts and asked the trial panel to accept them in the quality of evidence.
The trial panel decided to adjourn the public hearing on 14.05.2021, at 10:30, in order to make a decision on the request of the Public Commissioner to open an investigation and the request of the assessee to collect new evidence.
The public hearing shall take place at the premises of the Appeal Chamber, at: Bulevardi “Dëshmorët e Kombit”, nr.3. Tiranë.
