Kolegji i Posaçëm i Apelimit zhvilloi më datë 09.07.2025, ora 11:00, seancën gjyqësore publike të çështjes (JR) 56/2024, datë 27.12.2024, që i përket ankimit të Komisionerit Publik kundër vendimit të Komisionit të Pavarur të Kualifikimit nr. 811, datë 08.11.2024, që lidhet me subjektin e rivlerësimit Eranda Laze.

Fillimisht, përfaqësuesi i Drejtuesit të Prokurorisë së Posaçme iu përgjigj pyetjeve që relatori i çështjes i pati drejtuar në seancën e mëparshme, të datës 25.06.2025, në funksion të shqyrtimit të çështjes.

Në vijim, subjekti i rivlerësimit kërkoi të pranohet në cilësinë e provës një dokument i lëshuar nga Prokuroria pranë Gjykatës së Shkallës së Parë të Juridiksionit të Përgjithshëm Vlorë, i cili u refuzua nga trupi gjykues në seancën e datës 25.06.2025, duke i dhënë mundësi subjektit të rivlerësimit ta paraqiste në formën e kërkuar nga ligji, nëse e konsideronte të rëndësishme për çështjen. Trupi gjykues, pasi dëgjoi qëndrimin e përfaqësuesit të Drejtuesit të Prokurorisë së Posaçme, i cili shprehu dakordësinë që ky akt t’i nënshtrohej debatit gjyqësor, vendosi pranimin e kërkesës.

Pasi palët deklaruan se nuk kishin kërkesa të tjera, trupi gjykues vendosi mbylljen e hetimit gjyqësor dhe i ftoi ato të paraqisnin konkluzionet e tyre përfundimtare për çështjen.

Përfaqësuesi i Drejtuesit të Prokurorisë së Posaçme deklaroi se i qëndron shkaqeve të ankimit dhe se subjekti i rivlerësimit, znj. Eranda Laze, gjendet në kushtet e deklarimit të pasaktë e të pamjaftueshëm të pasurisë si dhe ka mungesë të burimeve të ligjshme për të justifikuar pasurinë e saj dhe të personave të lidhur me të. Z. Adnan Xholi vlerësoi bindëse shpjegimet e subjektit të rivlerësimit lidhur me kriterin e vlerësimit të figurës, ndërsa përsëriti qëndrimin e tij se znj. Laze ka treguar mangësi në tregimin e një kujdesi të shtuar në veprimtarinë jashtëgjyqësore. Përfundimisht, përfaqësuesi i Drejtuesit të Prokurorisë së Posaçme i kërkoi Kolegjit ndryshimin e vendimit të Komisionit të Pavarur të Kualifikimit nr. 811, datë 08.11.2024 dhe shkarkimin nga detyra të subjektit të rivlerësimit Eranda Laze.

Subjekti i rivlerësimit deklaroi se Komisioneri Publik në ankimin e tij nuk ka arsyetuar konform ligjit dhe provave në dosje, se ky ankim ka karakter hipotetik e paragjykues dhe si i tillë, nuk mund të jetë shkak për marrjen e një vendimi shkarkimi nga detyra. Përfundimisht, subjekti i rivlerësimit i kërkoi Kolegjit të marrë në konsideratë të gjitha provat në dosje dhe pasi t’i vlerësojë ato, të vendosë rrëzimin e ankimit të Komisionerit Publik si të pabazuar në ligj, si dhe lënien në fuqi të vendimit të Komisionit të Pavarur të Kualifikimit nr. 811, datë 08.11.2024.

Pasi dëgjoi konklzuionet përfundimtare të palëve, trupi gjykues vendosi mbylljen e shqyrtimit gjyqësor dhe u tërhoq në dhomë këshillimi për marrjen e vendimit përfundimtar, të cilin do ta shpallë më datë 29.07.2025, ora 15:00.

Seanca publike do të zhvillohet në ambientet e Kolegjit të Posaçëm të Apelimit, në adresën: Bulevardi “Dëshmorët e Kombit”, nr. 3, Tiranë.

The Appeal Chamber held on 09.07.2025, at 11:00, the public hearing of case (JR) 56/2024, dated 27.12.2024, pertaining to the appeal of the Public Commissioner against decision no. 811, dated 08.11.2024 of the Independent Qualification Commission, related to the assessee Eranda Laze.

Initially, the representative of the Head of the Special Prosecution office responded to the questions that the case rapporteur had addressed in the previous hearing, dated 25.06.2025, in view of the examination of the case.

Subsequently, the assessee requested the admission as evidence of a document issued by the Prosecution office at the First Instance Court of General Jurisdiction of Vlora, which was dismissed by the trial panel in the hearing dated 25.06.2025, providing the assessee the opportunity to submit it in the form required by law, if she considered it relevant for her case. The trial panel, after hearing the position of the representative of the Head of the Special Prosecution office, who agreed to subject this document to judicial debate, decided to accept it.

Once the parties declared that they had no other requests, the trial panel decided to close the judicial investigation and invited them to submit their final conclusions on the case.

The representative of the Head of the Special Prosecution Office stated that he stands by the appeal grounds and that the assessee, Ms. Eranda Laze, is found in terms of inaccurate and insufficient declaration of assets and there is a lack of legitimate sources to justify her assets and those of the persons related to her. Mr. Adnan Xholi assessed convincing the explanations of the assessee regarding the background assessment criteria, while reiterating his position that Ms. Laze has shown deficiencies in displaying increased diligence in extrajudicial activity. Finally, the representative of the Head of the Special Prosecution Office requested the Chamber the amendment of decision no. 811, dated 08.11.2024 of the Independent Qualification Commission and the dismissal from office of the assessee Eranda Laze.

The assessee stated that the Public Commissioner failed to argue his appeal in accordance with the law and the evidence in the case file, that this appeal is hypothetical and prejudicial in nature and as such, cannot be a ground for issuing a decision to dismiss her from office. Finally, assessee requested the trial panel to take into consideration all the evidence in the case file and, after their evaluation, decides to dismiss the Public Commissioner’s appeal as unfounded in law, as well as the upholding of decision no. 811, dated 08.11.2024 of the Independent Qualification Commission.

After hearing the final conclusions of the parties, the trial panel decided to close the judicial review and withdrew in chambers to make the final decision, which it shall announce on 29.07.2025, at 15:00.

The public hearing shall take place at the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.

The Appeal Chamber held on 24.07.2025, at 11:00, the public hearing of case (JR) 6/2023, dated 03.02.2023, pertaining to the appeal of the Public Commissioner against decision no. 598, dated 13.12.2022 of the Independent Qualification Commission, related to the assessee Genci Mane.

The presiding judge announced that the Appeal Chamber has received the second responses of Tirana Universal Service Provider Power Supply System Operator, Fier Regional Directorate, and the Water Supply and Sewerage Company Sh.A, and they had been forwarded to the parties, who confirmed their acquaintances with them.

The representative of the Head of the Special Prosecution Office, Mr. Adnan Xholi, stated with regard to the responses, that there are no copies of acts on the basis of which contracts were concluded between these entities and the assessee.

The assessee maintained that they confirmed the position he held in the previous hearing, dated 14.07.2025, that the responses of the institutions were exhaustive, as such contracts do not exist.

Subsequently, to the purpose of the consideration of the case, the assessee responded to several questions of the rapporteur.

After administering as evidence the responses of the institutions and the positions of the parties held during today’s hearing, the trial panel decided to close the judicial investigation of the case and invited the parties to present their final conclusions.

During their submission, the representative of the Head of the Special Prosecution stated that even during the judicial proceedings conducted at the Appeal Chamber, the assessee failed to prove the opposite of the appeal grounds. Mr. Xholi assessed that the assessee is found in a situation of inaccurate and insufficient declaration and fails to cover his assets with legitimate sources. As to the proficiency assessment, Mr. Adnan Xholi requested the Chamber the assessment of repeated shortcomings, observed during the exercise of the office by the assessee, along with the issues in the asset assessment criterion, deciding the amendment of decision no. 598, dated 13.12.2022 of the Independent Qualification Commission and the dismissal from office of the assessee Genci Mane.

The assessee submitted his final conclusions, providing summarily his explanations in response to the appeal grounds and in reference to the evidence in the case file, finally requesting the Chamber the upholding of the decision no. 598, dated 13.12.2022 of the Independent Qualification Commission.

After hearing the final conclusions of the parties, the trial panel withdrew in chambers to make the final decision, which it shall announce on 29.07.2025, at 14:00.
