Në Kolegjin e Posaçëm të Apelimit është regjistruar çështja (JR) nr.7/2021, datë 28.01.2021 që i përket ankimit të Komisionerit Publik kundër vendimit nr. 287, datë 04.08.2020 të Komisionit të Pavarur të Kualifikimit që lidhet me subjektin e rivlerësimit Anita Mici.

Sot, në datën 08.02.2021, në Kolegjin e Posaçëm të Apelimit, u hodh shorti për caktimin e trupit gjykues, kryesuesin e këtij trupi dhe relatorin e çështjes.

Trupi gjykues i caktuar me short është i përbërë si më poshtë vijon:

The Appeal Chamber has registered the case (JR) no.7/2021, dated 28.01.2021 corresponding to the appeal of the Public Commissioner against decision no. 287, dated 04.08.2020 of the Independent Qualification Commission related to the assessee Anita Mici.

Today, on 08.02.2021, the lot was drawn at the Appeal Chamber to assign the adjudication panel, the Presiding judge and the Rapporteur of the case.

The adjudication panel, assigned by lot, consists of judges:

Today, on 09.02.2021, at 10:00 h, the Appeal Chamber held the public hearing of case (JR) no.51/2020, dated 23.11.2020, corresponding to the appeal of the assessee Alaudin Malaj against decision no. 294, dated 15.09.2020, of the Independent Qualification Commission.

During the verification of the presence of the parties, the presiding judge noticed the absence of the assessee, Mr. Alaudin Malak and informed that Mr. Malaj had addressed a written request to the Appeal Chamber, accompanied by a medical report, requesting the postponement of the hearing for objective impossibility due to health reasons.

Pursuant to Article 175, second paragraph, of the Civil Procedures Code, the panel decided to adjourn the hearing of the case on 17.02.2021, at 1:00 h.

The public hearing will take place in the premises of the Appeal Chamber, at: Boulevard “Dëshmorët e Kombit”, no.3. Tirana.

Kolegji i Posaçëm i Apelimit zhvilloi sot, më datë 09.02.2021, ora 10:00, seancën gjyqësore publike të çështjes (JR) 51/2020, datë 23.11.2020, që i përket ankimit të subjektit të rivlerësimit Alaudin Malaj kundër vendimit nr. 294, datë 15.09.2020, të Komisionit të Pavarur të Kualifikimit.

Gjatë verifikimit të prezencës së palëve kryesuesja e seancës konstatoi mungesën e subjektit të rivlerësimit z. Alaudin Malaj dhe bëri me dije se z.Malaj i ka drejtuar Kolegjit një kërkesë me shkrim, të shoqëruar me një raport mjekësor, ku kërkon shtyrjen e seancës për pamundësi objektive për arsye shëndetësore.

Bazuar në nenin 175, paragrafi i dytë, i Kodit të Procedurës Civile, trupi gjykues vendosi shtyrjen e seancës gjyqësore për në datën 17.02.2021, ora 13:00.

Seanca gjyqësore publike do të zhvillohet në ambientet e Kolegjit të Posaçëm të Apelimit, në adresën: Bulevardi “Dëshmorët e Kombit”, nr.3. Tiranë.

Trupi gjykues i Kolegjit të Posaçëm të Apelimit, i përbërë nga Natasha Mulaj kryesuese, Albana Shtylla relatore, Ardian Hajdari, Rezarta Schuetz, Sokol Çomo anëtarë, shpalli vendimin për çështjen (JR) nr.41/2019 datë 06.09.2019, që lidhet me ankimin e subjektit të rivlerësimit Eugen Beçi, kundër vendimit nr. 171, datë 26.06.2019 të Komisionit të Pavarur të Kualifikimit.

Në përfundim të gjykimit, trupi gjykues, bazuar në nenin 66, pika 1, shkronja “a” e ligjit nr.84/2016, “Për rivlerësimin kalimtar të gjyqtarëve dhe prokurorëve në Republikën e Shqipërisë”, me shumicë votash, vendosi:

1. Lënien në fuqi të vendimit nr. 171, datë 26.06.2019 të Komisionit të Pavarur të Kualifikimit, që i përket subjektit të rivlerësimit Eugen Beçi.
2. Ky vendim është përfundimtar dhe ka efekt të menjëhershëm.

U shpall sot, në Tiranë, më datë 09.02.2021.

The adjudication panel of the Appeal Chamber, composed of judges, Natasha Mulaj, presiding, Albana Shtylla, rapporteur, Ardian Hajdari, Rezarta Schuetz, and Sokol Çomo members, announced the decision on case (JR) no.41/2019 dated 06.09.2019, corresponding to the appeal of the assessee Eugen Beçi, against decision no. 171, dated 26.06.2019 of the Independent Qualification Commission.

At the conclusion of the adjudication, the trial panel, pursuant to Article 66, paragraph 1/a, of Law no. 84 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, upon a majority vote, decided:

1. To uphold decision no. 171, dated 26.06.2019 of the Independent Qualification Commission, related to the assessee Eugen Beçi.
2. This decision is final and effective immediately.

Announced in Tirana, today on 09.02.2021.

Ditën e martë, më datë 02.03.2021, ora 10:00, do të gjykohet në dhomë këshillimi çështja (JR) nr.3/2021 datë 14.01.2021 që i përket ankimit të subjektit të rivlerësimit Bilbil Mete kundër vendimit të Komisionit të Pavarur të Kualifikimit nr. 322, datë 10.12.2020.

Trupi gjykues për gjykimin e kësaj çështjeje përbëhet nga:

Kolegji i Posaçëm i Apelimit zhvilloi sot, më datë 11.02.2021, ora 10:00, seancën gjyqësore publike të çështjes (JR) 55/2019, datë 29.10.2019, që i përket ankimit të Komisionerit Publik kundër vendimit nr. 173, datë 01.07.2019, të Komisionit të Pavarur të Kualifikimit që lidhet me subjektin e rivlerësimit Artan Madani.

Pas verifikimit të prezencës së palëve, subjekti i rivlerësimit Artan Madani paraqiti si kërkesë paraprake para trupit gjykues shtyrjen e seancës gjyqësore për një periudhë 2-javore, për pamundësi objektive të përfaqësuesit të tij ligjor për ta asistuar në seancë, për arsye shëndetësore.

Pasi Komisioneri Publik shprehu dakordësinë me këtë kërkesë të subjektit të rivlerësimit dhe pasi trupi gjykues legjitimoi përfaqësuesin ligjor si palë në proces, bazuar në nenin 175, paragrafi i dytë, i Kodit të Procedurës Civile, trupi gjykues vendosi shtyrjen e seancës gjyqësore për në datën 23.02.2021, ora 10:00.

Seanca gjyqësore publike do të zhvillohet në ambientet e Kolegjit të Posaçëm të Apelimit, në adresën: Bulevardi “Dëshmorët e Kombit”, nr.3. Tiranë.

Today, on 11.02.2021, at 10:00 h, the Appeal Chamber held the public hearing of case (JR) no.55/2019, dated 29.10.2019, corresponding to the appeal of the Public Commissioner against decision no. 173, dated 01.07.2019, of the Independent Qualification Commission related to the assessee Artan Madani.

After verifying the presence of the parties, the assessee Artan Madani submitted as a preliminary request before the trial panel the postponement of the hearing for a period of 2 weeks, for objective impossibility of his legal representative to assist him in the hearing, due to health reasons.

Once the Public Commissioner agreed with this request of the assessee and after the trial panel legitimized the legal representative as a party at trial, based on Article 175, second paragraph, of the Civil Procedure Code, the trial panel decided to postpone the hearing on 23.02.2021, at 10:00 h.

The public hearing will take place in the premises of the Appeal Chamber, at: Boulevard “Dëshmorët e Kombit”, no.3. Tirana.

Trupi gjykues i Kolegjit të Posaçëm të Apelimit, i përbërë nga Sokol Çomo kryesues, Rezarta Schuetz relatore, Albana Shtylla, Ardian Hajdari, Natasha Mulaj, anëtarë, shpalli vendimin për çështjen (JR) nr.39/2019 datë 04.09.2019, që lidhet me ankimin e subjektit të rivlerësimit Evelina Qirjako, kundër vendimit nr. 178, datë 08.07.2019 të Komisionit të Pavarur të Kualifikimit.

Në përfundim të gjykimit, trupi gjykues, bazuar në nenin 66, pika 1, germa “a” e ligjit nr.84/2016, “Për rivlerësimin kalimtar të gjyqtarëve dhe prokurorëve në Republikën e Shqipërisë”, me shumicë votash, vendosi:

1. Lënien në fuqi të vendimit nr. 178, datë 08.07.2019 të Komisionit të Pavarur të Kualifikimit, që i përket subjektit të rivlerësimit Evelina Qirjako.
2. Ky vendim është përfundimtar dhe ka efekt të menjëhershëm.

U shpall sot, në Tiranë, më datë 12.02.2021.

Today, on 03.02.2021, at 10:00 h, the Appeal Chamber held the public hearing of case (JR) no.39/2019, dated 04.09.2019, corresponding to the appeal of the assessee Evelina Qirjako against decision no. 178, dated 08.07.2019, of the Independent Qualification Commission.

The assessee Mrs. Evelina Qirjako made available to the trial panel the decision no. 6, dated 26.01.2021, of Tirana Administrative Court of Appeal, related to her lawsuit before this court.

After withdrawing for consultation and being acquainted with the content of the decision in question, the trial panel, upon a majority vote, decided to collect this decision as evidence in the adjudication in the Appeal Chamber.

Following this procedural instance, the assessee Mrs. Evelina Qirjako declared the waiver from the request for the suspension of the trial in the Appeal Chamber and requested the continuation of the review of her appeal against the IQC decision no. 178, dated 08.07.2019.

The trial panel decided to continue the trial of the case, inviting the assessee, Mrs. Qirjako, to submit her claims with regard to the appeal filed with the AC.

The hearing continued with the submission of the assessee, Mrs. Evelina Qirjako, after which the trial panel decided to close the judicial review. Ms. Qirjako requested in her final conclusions the overruling of paragraph 2 of the IQC decision no. 178, dated 08.07.2019, taking into account the decision of Tirana Administrative Court of Appeal.

The presiding judge declared the adjourning of the hearing to the purpose of announcing the final decision, to be held on 12.02.2021, at 13:00h.
