The Appeal Chamber held today, on 01.10.2019, at 10:00 h, the public hearing of case (JR) no. 33/2018, dated 12.11.2018, corresponding to the appeal of the Public Commissioner against decision no. 58 dated 01.08.2018 of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Besnik Muçi.
The adjudication panel, by majority vote, decided to accept the request of the Public Commissioner to collect as evidence the information forwarded to the Public Commissioners from CSID on 16.11.2018, and decided to forward this document to the assessee, once the procedures of its declassification are over.
During his submissions on the probative value of the evidences submitted by the assessee in the previous hearing, the Public Commissioner stated that the assessee, neither upon these acts, proves credibly the lawful source of creation of his assets and assets of persons related to him.
To the purpose of review of the case, the assessee requested the collection as evidence of two new bank documents, a request accepted by the adjudication panel.
Also, pursuant to the decision for the collection as evidence of the CSID document, the adjudication panel decided to request to the competent authority that within a reasonable time, within the 15-day time limit set by the law, to declassify the document classified as “secret”.
Pending the response of the competent authority, the adjudication panel decided to adjourn the hearing on 16.10.2019, at 12:00 h.
The public hearing shall be held at the premises of the Appeal Chamber, at: Bulevardi “Dëshmorët e Kombit”, nr.3. Tirana.
