On 05.12.2022, at 10:00, the Appeal Chamber held the public hearing of case (JR) 47/2020, dated 22.10.2020, pertaining to the appeal of the Public Commissioner against decision no. 264, dated 17.06.2020, of the Independent Qualification Commission, related to the assessee Elona Toro.
During the submission of the appeal grounds, the Public Commissioner requested the Chamber to reopen the judicial investigation to the purpose of conducting a financial analysis based on a reassessment of the financial capacities of the related persons and other persons related to the assessee. As regards the denunciations, the Public Commissioner held that they do not contain sufficient grounds to be added to the appeal.
During the submission of objections related to the grounds of the appeal, the assessee requested the Chamber to open the judicial investigation and to collect as evidence the new acts she filed during today’s hearing, along with the submissions.
After being consulted, the trial panel decided to open the judicial investigation of the case and to accept as evidence the documents filed by the assessee during today’s hearing. With regard to the denunciations, the panel assessed that they do not meet the criteria of Article 53 of Law 84/2016 “On the re-evaluation of judges and prosecutors in the Republic of Albania” and therefore, they shall not be subject to further investigation by the Chamber.
Upon a majority vote, the trial panel decided to accept the request of the Public Commissioner that the AC conducts a preliminary financial analysis, and it shall make available to the parties by December 15, 2022.
In order to provide sufficient time to the parties to debate on the preliminary financial analysis, the trial panel decided to postpone the hearing to December 21, 2022, at 10:00.
The public hearing shall take place in the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.
