The Appeal Chamber held on 14.07.2025, at 13:00, the public hearing of case (JR) 6/2023, dated 03.02.2023, pertaining to the appeal of the Public Commissioner against decision no. 598, dated 13.12.2022 of the Independent Qualification Commission, related to the assessee Genci Mane.

Following the interim decision of the previous hearing, the presiding judge announced that the Chamber has received the responses of the Tirana Universal Service Provider, the Power Supply Distribution System Operator, Fier Regional Directorate, and the Water Supply and Sewerage Company Sh.A., and it have been forwarded to the parties, who confirmed their acquaintance with them.

Referring to the responses, the representative of the Head of the Special Prosecution Office, Mr. Adnan Xholi, stated that the institutions have failed to deliver the documents as requested in the Appeal Chamber’s letter, so he requested that the latter addresses them once more, requesting copies of the contracts concluded by the subscriber Genci Mane if such contracts exist, as well as the acts attached to them.

The assessee stated that the responses of the institutions are exhaustive, as there are no such contracts concluded between him and the above entities.

With regard to a new complaint received by the Chamber, the representative of the Head of the Special Prosecution Office stated that after being acquainted with it, it had not resulted that it contained circumstances for further investigations. Regarding this complaint, the assessee filed a letter from the Prosecution office at the First Instance Court of General Jurisdiction of Fier, which he requested the trial panel to collect it as evidence.

After being consulted, the trial panel decided to accept the request of the representative of the Head of the Special Prosecution Office, addressing once again the institutions, as well as the request of the assessee to accept as evidence the letter regarding the denunciation. Under Article E of the Annex to the Constitution, as well as under Article 53 of Law 84/2026 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, the trial panel decided to not conduct further investigations regarding the denunciation.

The trial panel decided to postpone the hearing to 24.07.2025, 11:00, a hearing where the parties must also be prepared for the final conclusions.

The public hearing shall take place at the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.
