Today, on 11.01.2021, at 12:00 h, the Appeal Chamber held the public hearing of the case (JR) no. 51/2020, dated 23.11.2020, corresponding to the appeal of the assessee Alaudin Malaj against decision no. 294, dated 15.09.2020, of the Independent Qualification Commission.
After being informed and consulted with regard to the preliminary request of the assessee Alaudin Malaj to not allow the participation of the media in his hearing, as well as the prohibition of its publication, the trial panel decided to dismiss the request, assessing that it is not found in any of the terms of Article 20 of Law no. 49/2012 “On administrative courts and adjudication of administrative disputes”, as amended. The object of the appeal of the assessee is the decision of the Independent Qualification Commission which is no cause related to privacy, protection of public morals, public order, national security or trade secrecy.
The assessee was heard by the trial panel as he submitted his objections regarding the proceedings at the Independent Qualification Commission. To the purpose of the review of the case the assessee, Mr. Malaj submitted two new additional acts, one of which, the lawsuit filed by him with the Administrative Court of First Instance Tirana, against the decision of the Independent Qualification Commission, upon postal receipt dated 17 June 2020, was admitted as evidence by the trial panel. With regard to the other act, the trial panel requested the assessee to bring it back in the form required by law, as it was only an uncertified copy.
The trial panel decided also to provide the assessee the opportunity to get acquainted with the procedural acts of the case file of the Independent Qualification Commission related to the addressing the requests of the assessee with object the recusal of the trial panel members. To this aim, the hearing was postponed to be held on January 27, 2021, at 10:00 h.
The public hearing will take place in the premises of the Appeal Chamber, at: Boulevard “Dëshmorët e Kombit”, no.3. Tirana.
